We felt it necessary to continue signing the letter of our representation to you in the path of democratic efforts and bringing the freedom-loving voice of the Iranian people to international forums, to announce the clear positions of this party regarding the charter issued under the title of solidarity and organization for freedom (MAHSA).
In the previous days, individuals and groups who want the monarchy have raised many questions and doubts about the charter published by the group of six.
Based on our belief, we consider you the only trustworthy and committed person, with the support of people and struggles of forty years, who can guide the affairs of transition and return our beloved country to the horizons of happiness. We deliver
1. This huge movement was the result of a decades-long process of continuous protests by different sections of Iran’s freedom-loving people and the sacrifice of many precious lives, and now that it has reached maturity at its turning point, with the rise of the women and girls of this land and the support of its men, it has a new life. And it has changed.
Based on this, we consider the universal title “Women, Life, Freedom” to be more suitable for this huge approach due to its comprehensiveness and inclusion of the names of all living beings.
We believe that you also cannot forget the memory of the injured and the dead of the student uprisings, farmers, the martyrs of November 2019, and the pensioners’ protests and many such cases, which have marked the trend leading to the recent events.
2. Considering your political background and valuable experiences, we expect you to provide the necessary advice and warnings to avoid including incomprehensible, double-edged and dubious legal points and phrases in the text of the charter.
3. Under the title “democratic governance”, clauses one, two, and three of the charter contain several obvious legal and political contradictions.
Paragraph one:
“All political and official officials are elected through free and democratic elections”
– Were the authors of this charter unaware of the non-election of the judiciary or how they were selected?
Based on the principle of separation of powers, although the judiciary should not and cannot directly interfere in political affairs, it is in political partnership with the other two branches to perform governmental duties.
– Are the members of the Council of Ministers also chosen through free elections or does the head of government introduce them to the members of parliament to obtain a vote of confidence?
Paragraph two:
“Maintaining the Territorial Integrity of Iran”
Among the incomprehensible and two-sided points is the Charter of Solidarity and Organization for Freedom (Mahsa).
The country of Iran has ethnicities, religions, and a diversity of cultures. This country has only one land with territorial integrity with specific land, water, and air boundaries.
This phrase contains conceptual and ultimately legal doubts.
Paragraph three:
“Decentralization of Power”
This phrase also contains conceptual doubts and legal obstacles.
If the goal of decentralization is the existence of multiple parties, city councils, trade unions, etc. to participate in the correct implementation of laws, we consider this to be acceptable and effective.
“Delegating policy-making powers”
Major internal and external policies, within the framework of a single country, should be approved and announced by a legal and unified centrality, taking into account the national interests of all the borders and territories of that country. Therefore, policy-making in a general and vague concept, as included in the text of the charter, cannot include the aforementioned goals and the trust of foreign governments.
Important note:
– Clauses one and three of this charter have already blocked the people’s right to vote in a free election to choose the monarchy and hereditary government.
– The charter of solidarity and organization for Iran has left the issue of introducing the content of the future government and has assumed this undemocratic right to decide on the form and structure of the government without holding free elections.
– Choosing the title of the charter (decree) to announce the results of the discussion and consultation of the six-member group has a negative meaning. This title reinforces the disregard for the public’s right to self-determination.
– Failure to pay attention to the mention of the three-color flag of the lion and the sun as a symbol of the unification of Iran’s nations, religions, languages, and cultures in the aforementioned charter leads to the assumption that this solidarity is weak.
Paragraph seventeen:
“Focusing on compensatory policies and special economic privileges…”
– Although the empowerment of deprived regions and provinces through development and eradicating poverty is accepted and emphasized, with the content of paragraph three, regarding the emphasis on decentralization and the granting of broad financial, administrative, and policy-making powers, there is a contradiction and contradiction. has
If the meaning of decentralization mentioned in paragraph three is the development of parties and guilds and provincial and local legal institutions in the direction of the growth and development and reconstruction of provinces and cities, then paragraph seventeen should be called “the need to pay attention to the development and development of deprived areas”. would take
– The emphasis on “granting special facilities” is a legal and judicial violation of “eliminating economic monopolies” contained in paragraph seventeen, and we consider this to be against general social justice everywhere in Iran.
